Welcome to PaperCottageHill ("we," "our," or "us"). These Terms & Conditions ("Terms") regulate your use of our yacht charter services and our website at papercottagehill.sbs (the "Service"), operated by PaperCottageHill.
By reserving a charter or using our Service, you accept these Terms. If you do not agree with any part of these terms, you are not permitted to use the Service.
2. Service Overview
PaperCottageHill offers luxury yacht charter services, which include but are not limited to:
- Day rentals of yachts
- Evening cruises
- Business retreats
- Exclusive gatherings
- Extended charters
All offerings are contingent upon availability and weather conditions. We reserve the authority to change or discontinue services at our discretion.
3. Booking and Reservations
3.1 Booking Process
When booking a charter, you are required to:
- Be a minimum of 18 years old
- Provide truthful and complete details
- Pay a stipulated deposit as detailed in the booking confirmation
- Consent to these Terms & Conditions
3.2 Confirmation
Your reservation is only confirmed once payment is received and we provide written affirmation. We reserve the right to deny service to any person at our sole discretion.
3.3 Availability
All charters depend on vessel availability and appropriate weather conditions. We will endeavor to fulfill your requested dates and times.
4. Payment Terms
4.1 Pricing
All price estimates are in € and include relevant taxes unless indicated otherwise. Prices are subject to change without prior notice.
4.2 Payment Schedule
- Deposit: 50% of the overall charter cost is due upon booking
- Balance: Payable 48 hours before the departure of the charter
- Incidental fees (if any): Payable after the charter is completed
4.3 Payment Methods
Payments can be completed via major credit cards, electronic bank transfers, and certified cheques. Safe and encrypted systems handle our payment processes.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- With more than 72 hours before departure: Full refund minus transaction fees
- Between 24 and 72 hours before departure: Half the amount refunded
- Less than 24 hours before departure: No refund issued
5.2 Weather Cancellations
In the event the captain deems weather conditions unsafe, we will propose to:
- Postpone your charter to an alternative available date at no extra cost
- Issue a full refund if an alternative date cannot be scheduled
5.3 Mechanical Issues
If your assigned vessel encounters mechanical issues, we will attempt to offer an appropriate replacement. If no substitute is available, you will receive a full refund.
6. Safety and Conduct
6.1 Safety Requirements
All guests are required to:
- Adhere to all instructions from the crew
- Use safety equipment as necessary
- Disclose any medical conditions that may impact their safety
- Stay in areas of the vessel designated for passengers
6.2 Prohibited Items
The following items are prohibited on board:
- Glassware
- Illegal substances
- Firearms or weapons
- Drinks beyond reasonable quantities for personal consumption
- Animals (except when pre-approved)
6.3 Conduct
Passengers are expected to behave respectfully. Should passenger conduct create a safety hazard or interrupt the enjoyment of others, we reserve the right to end the charter prematurely without issuing a refund.
7. Liability and Insurance
7.1 Our Liability
Our accountability is capped at the price paid for your charter. We are not liable for:
- Injuries caused by passenger misconduct
- Theft or destruction of personal belongings
- Indirect or punitive damages
- Delays due to weather or events outside of our control
7.2 Insurance Coverage
We uphold comprehensive marine insurance that covers our vessels and operational activities. It is the responsibility of passengers to secure their travel and personal insurance.
7.3 Assumption of Risk
By participating in our charter services, you acknowledge the intrinsic risks of marine activities and assume responsibility for your own safety and well-being.
8. Modifications and Itinerary Changes
We may alter itineraries, paths, or schedules due to weather, safety reasons, or operational necessities. We strive to provide suitable alternative experiences.
9. Force Majeure
We are not accountable for disruptions, cancellations, or changes attributed to forces beyond our control, which may include, but are not limited to:
- Extreme weather conditions
- Natural catastrophes
- Governing edicts
- Closures of ports
- Machine malfunctions
10. Privacy and Data Protection
We manage your personal data in alignment with our Privacy Policy. Engaging our services signifies your consent to the documentation and exploitation of your information per the Privacy Policy.
11. Intellectual Property
Our website's content, including text, designs, logos, and imagery, is safeguarded by copyright and trademark laws. Replication, distribution, or creation of derivative works requires our prior written consent.
12. Governing Law
The governing law for these Terms is the laws of Germany. Any dispute resolution will occur in the courts located in Hamburg, Germany.
13. Changes to Terms
